Office of the Fire Marshal Existing Occupancy Inspection Program

In 2023, the Office of the Fire Marshal revamped the Existing Occupancy Inspection Program to comply with inspection frequency requirements of the Florida Fire Prevention Code (FFPC).

Under FFPC NFPA 1: 10.2.7 Minimum Fire Prevention Inspection Frequencies for Existing Occupancies, the inspection frequency for all buildings, except one and two family dwellings, are required to follow the below:

  • High Risk Occupancies and Critical Infrastructure – Annual Inspections
  • Moderate Risk Occupancies – Biennial Inspections (once every two years)
  • Low Risk Occupancies – Triennial Inspections (once every three years)

High Risk Occupancies are those that have a high frequency of fires, a high potential for loss of life or economic loss should a fire occur or have a high dependency on built-in fire protection features or staff to assist in evacuation. Examples include:

  • Apartment complexes
  • Hotels
  • Assembly venues
  • Healthcare facilities
  • Assisted Living Facilities
  • High-hazard industrial facilities

Critical Infrastructure are those that are vital or essential to the safety and welfare, functionality and economy or the community. Examples include:

  • Hospitals
  • Water and power plants
  • Fire stations & 911 centers

Moderate Risk Occupancies are those that have a moderate frequency of fires or a moderate potential for loss of life or economic loss should a fire occur. Examples include:

  • Ambulatory Healthcare facilities
  • General industrial facilities

Low Risk Occupancies are those with a low frequency of fires or a minimal potential for loss of life or economic loss. Examples include:

  • General business sites
  • Mercantile and retail facilities
  • Storage facilities

The cost of an inspection for an occupancy that is 2000 square feet in size or less in size is $90. If an occupancy is larger than 2000 square feet, an additional $.02 will be charged for each additional square foot up to a cap of $5,000 per building and $8,000 per property. If there are violations found during the inspection, a re-inspection fee of $47 is charged for each return visit until the violations are corrected.
