The Zoning Division reviews applications for determinations of Substandard Lots of Record for parcels that do not meet the minimum lot requirements established by Orange County Code Section 38-1501. These determinations are conducted in accordance with Orange County Code Section 38-1401.
A Substandard Lot of Record is a lot that does not meet the minimum development requirements established by Orange County Code Section 38-1501, but which existed prior to the adoption of Chapter 38 of the Orange County Zoning Code.
A Substandard Lot of Record may be developed with permitted principal and accessory uses, subject to confirmation by the Orange County Zoning Division that the parcel qualifies as a Substandard Lot of Record and provided that the proposed principal structure complies with all applicable development standards of the zoning district.
In order to confirm a lot is a substandard lot of record, two items of information about the lot must be confirmed;
- That the lot is in the same configuration, has the same property description, as it did prior to the adoption of Zoning Code, Orange County Chapter 38, on October 7, 1957.
- That the lot has not been in contiguous ownership with a neighboring lot dating back to the adoption of Zoning Code, Orange County Code Chapter 38, on October 7, 1957.
